WHEREAS, the City of Burlington has adopted Section 165-2 of the Municipal Code regulating the use of the official City logo; and

WHEREAS, Section 165-2 of the Municipal Code states that "any person, partnership, limited liability company or corporation wishing to use the "Chocolate City USA" logo shall file an application with the City Clerk, who shall schedule the application for consideration by the Common Council; and,

WHEREAS, Baseball 2000 has made a request to the City of Burlington to use the "Chocolate City USA" logo by submitting an application to the City Clerk.

NOW, THEREFORE, BE IT RESOLVED that the Common Council has reviewed said application, which is attached hereto as "Attachment A", and determined that use of the "Chocolate City USA" logo is likely to promote the City.

BE IT FURTHER RESOLVED that the Common Council grants Baseball 2000 the right to use the "Chocolate City USA" logo for items prepared for the 2007 16-U State Baseball Tournament, including tournament programs, t-shirts, promotional posters and other items of a similar nature pursuant to a License Agreement between the City of Burlington and Baseball 2000 attached hereto as "Attachment B".

BE IT FURTHER RESOLVED that this Resolution shall not be effective until the applicant's execution of said Licensing Agreement and payment of the twenty five dollar ($25.00) license fee.

BE IT FURTHER RESOLVED that the City Clerk shall include Baseball 2000 on the list of individuals and businesses granted a license to use the "Chocolate City USA" logo as stated herein.
