WHEREAS the City of Burlington and Chocolate City Festivals, Inc, entered into a Lease for land owned by the City of Burlington on February 9, 1999, and the City now wishes to construct a public road over and across the Leased lands and to designate a public ingress and egress easement over which the roadway will be built; and

WHEREAS Chocolate City Festivals, Inc. has agreed to the building of the roadway and the creation of the easement, and has agreed to the Amendment of its Lease with the City in order to accommodate the roadway and the Easement; and

WHEREAS, under the terms of the Amendment to the Lease, the City will agree to close the roadway for general access during the period preceding, during and after ChocolateFest to allow the preparation for, the operation of, and the dismantling of the Festival:

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Burlington, Racine County, State of Wisconsin, to approve the Amendment to Lease attached hereto.

BE IT FURTHER RESOLVED that the Mayor is hereby authorized and directed to execute this Amendment to Lease on behalf of the City.

BE IT FURTHER RESOLVED that the Clerk is hereby directed to send a copy of this Amendment to Lease to Chocolate City Festivals, Inc. once it is fully executed by all parties.
