A FINAL RESOLUTION AUTHORIZING
SIDEWALK RECONSTRUCTION ON LEWIS ST., CREST ST. AND AT
VARIOUS LOCATIONS WHERE COMPLAINTS WERE RECEIVED AND
LEVYING SPECIAL ASSESSMENTS AGAINST THE BENEFITED
PROPERTIES
WHEREAS, the Common Council of the City of
Burlington, Racine County, Wisconsin, has held a public
hearing in the Common Council Chambers at 6:30 p.m. on
March 20, 2007 for the purpose of hearing all interested
parties concerning the initial resolution and the
engineering report on the proposed improvements
consisting of removal and replacement of sidewalks and
restoration of all disturbed areas where street
resurfacing or repairs are planned on or adjacent to:
Lewis St., Crest St and at various locations where
complaints have been received; and
WHEREAS, the Common Council has heard all persons
desiring audience at such hearing.
NOW THEREFORE, BE IT RESOLVED by the Common
Council of the City of Burlington as follows:

That the engineering
report pertaining to the construction of the above
described public improvements, including plans and
specifications thereof, is hereby adopted and
approved; and,
-
That the Board of
Public Works is hereby authorized to carry out the
work of such improvements in accordance with the
engineering report, amending the work dependent upon
actual bid prices received to not exceed a total of
$35,000 for all 2007 sidewalk improvements; and
-
That the payment for
said improvements is to be made by assessing fifty
percent (50%) of the cost to the property benefited
as included in said report pursuant to
§66.0703 of the Wisconsin Statutes and §274-3 of the
Code of the City of Burlington; and,
-
That benefits shown
on the report are true and correct, have been
determined on a reasonable basis, and are hereby
confirmed; and,
-
That the assessments
for all projects included in said report are hereby
combined as a single assessment but any interested
property owner shall be entitled to object to each
assessment separately or all of the
assessments jointly for any purpose or purposes;
and,
-
That the assessments
may be paid in cash or in three installments to the
City Clerk, installment payments to bear an interest
rate of five percent (5.0%) per annum on the unpaid
balance from the date of the publication of the
Installment Notice; and,
-
That all assessments
or installments not paid by the date due shall be
extended on the tax roll as a delinquent tax against
the property and all proceedings in relation to the
collection, return and sale of property for
delinquent real estate taxes apply to the special
assessment, except as otherwise provided by statute.

The City Clerk is
directed to publish this resolution as a Class I
notice in the official paper; and
-
The City Clerk is
further directed to mail a copy of this resolution
to every property owner whose name appears on the
assessment roll and whose post office address is
known or can be ascertained with reasonable
diligence.

The City Clerk is
further directed to publish an Installment Notice
pursuant to §66.0715(3)(e) when the contract is let
for the work.
