A RESOLUTION ADOPTING A CONNECTING HIGHWAY CHANGE AGREEMENT BETWEEN THE STATE OF WISCONSIN DEPARTMENT OF TRANSPORTATION AND THE CITY OF BURLINGTON FOR TWO-WAY TRAFFIC RECONFIGURATION

WHEREAS, the City of Burlington has worked with the Wisconsin Department of Transportation (DOT) to modify the present connecting highway system within the City’s downtown area from a one-way paired configuration to a two-way traffic roadway system; and,

WHEREAS, said improvements are now in place and traffic is utilizing this new approved connecting highway system; and,

WHEREAS, the State of Wisconsin provides connecting highway mileage aids pursuant to designated routes; and,

WHEREAS, the parties hereto do mutually agree to the change in connecting highway status described within the Connecting Highway Change Agreement Amendment to Connecting Highway change Agreement #154 (1998) Between the Wisconsin Department of Transportation and the City of Burlington, attached hereto as Attachment A; and

WHEREAS, this agreement will have no effect on current connecting highway mileage aids.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Burlington that the Connecting Highway Change Agreement Amendment to Connecting Highway change Agreement #154 (1998) Between the Wisconsin Department of Transportation and the City of Burlington, attached hereto as Attachment A is hereby approved.

BE IT FURTHER RESOLVED that the Mayor is hereby authorized and directed to execute said Agreement Amendment.

BE IT FURTHER RESOLVED that the City Clerk shall forward executed copies of said Agreement Amendment to the City Engineer, care of Tom Foht and to Frank Furdek, Wisconsin Department of Transportation, 141 NW Barstow Street, P.O. Box 798, Waukesha, WI 53187-0798.

CONNECTING HIGHWAY CHANGE AGREEMENT

AMENDMENT TO CONNECTING HIGHWAY CHANGE AGREEMENT #154 (1998)

BETWEEN

THE WISCONSIN DEPARTMENT OF TRANSPORTATION

AND

THE CITY OF BURLINGTON

This agreement, made and entered into by and between the Wisconsin Department of Transportation, hereinafter called the State, and the City of Burlington, hereinafter called the City,

Whereas, Section 86.32(1), Wisconsin Statutes enables the State to designate certain marked routes of the state highway system over the streets or highways in any municipality for which the municipality will be responsible for maintenance and traffic control, and

Whereas, the character of travel service provided by this route, uniformity of maintenance, the effect on the maintaining agency and the municipality’s maintenance capability are considerations predicating this designation, and

Whereas, reimbursement for maintenance of the connecting highway shall be determined using the rates per lane mile provided for under Section 86.32, Wisconsin Statutes, and

Whereas, Pine Street, Dodge Street and Chestnut Street located in Section 32, Township 3 North, Range 19 East, City of Burlington, Racine County are now two-way traveled streets, and

Whereas, this agreement is to serve as an amendment to Connecting Highway Change Agreement #154 (1998), attached, and

Whereas, this agreement will have no effect on current connecting highway mileage aids, and

Whereas, the parties hereto do mutually agree to the change in connecting highway status described below under the conditions as specified below,

ROUTE DESCRIPTION:

Delete existing STH 11 from the Connecting Highway System along the following streets:

  1. Chestnut Street from Chestnut Street and Pine/Herman Street(s) to Chestnut Street and Dodge Street, located in Section 32, Township 3 North, Range 19 East, City of Burlington, Racine County.

  2. Dodge Street from Dodge Street and Chestnut Street to Dodge Street and Adams Street located in Section 32, Township 3 North, Range 19 East, City of Burlington, Racine County.

  3. Jefferson Street from Jefferson Street and Pine Street to Jefferson and Main Street located in Section 32, Township 3 North, Range 19 East, City of Burlington, Racine County.

  4. Main Street from Main Street and Jefferson Street to Main Street and State Street located in Section 32, Township 3 North, Range 19 East, City of Burlington, Racine County

  5. Kendall Street from Kendall Street and Chestnut Street to Kendall Street and Pine Street located in Section 32, Township 3 North, Range 19 East, City of Burlington, Racine County

Add STH 11 to the Connecting Highway System along the following streets:

  1. Pine Street from the intersection of Pine Street and Kendall Street to the intersection of Pine/Herman Streets and Chestnut Street, located in Section 32, Township 3 North, Range 19 East, City of Burlington, Racine County.

  2. Pine Street from the intersection of Pine Street and Jefferson Street to the intersection of Pine Street and Adams Street, located in Section 32, Township 3 North, Range 19 East, City of Burlington, Racine County.

  3. Adams Street from the intersection of Adams Street and Pine Street to the intersection of Adams Street and Dodge Street, located in Section 32, Township 3 North, Range 19 East, City of Burlington, Racine County.

CONDITIONS OF DESIGNATION:

The effective date of this Connecting Highway Change shall be date of the execution of this agreement by the state.
