AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP BY REZONING THE

PROPERTY LOCATED on both sides of Buckley Street and south OF STH 36/83, from Rm-3/PUD, Low Density Multiple Residence District with a Planned Unit Development Overlay to C-1, Conservancy District;RM-3/PUD, Low Density Multiple Residence District with a Planned Unit Development Overlay to B-1/PUD, Neighborhood Business District with a Planned Unit Development Overlay; B-1, Neighborhood Business District to B-1/PUD, Neighborhood Business District with a Planned Unit Development Overlay; B-1, Neighborhood Business District to C-1, Conservancy District and FC, Floodplain Conservancy District to FW, Floodway District

WHEREAS, The Redmond Commercial Development Company, representing Hwy 36/ WII, LLC, has applied for a rezoning of property located on both sides of Buckley Street and south of STH 36/83; and,

WHEREAS, Hwy 36/W II, LLC is the owner of property located on both sides of Buckley Street and south of STH 36/83; and,

WHEREAS, this request was heard at, and recommended for approval by the Plan Commission at their December 12, 2006 meeting pursuant to Mr. Patrick Meehan, Meehan & Company, Inc. memorandum dated December 5, 2006 and,

WHEREAS, a public hearing was held regarding this matter at the Common Council’s December 19, 2006 meeting.

NOW THEREFORE BE IT ORDAINED, that the Common Council of the City of Burlington, County of Racine and the County of Walworth, State of Wisconsin does as follows:

Section 1. The district map of the City of Burlington, as it is incorporated by reference and made part of the City Zoning Ordinance, is hereby amended and changed in relation to the zoning classification of land more particularly described as follows:

Owner: Hwy 36/ WII, LLC
Applicant: The Redmond Commercial Development Company
Tax Key No. 206-03-19-22-004-033(P)
  206-03-19-22-004-002(P)
  206-03-19-21-023-000(P)
Mailing Address: W228 N745 Westmound Drive, Waukesha, WI 53186
Site Location: Located on both sides of Buckley Street and south of STH 36/83
Proposed Use: Retail use in the B-1/PUD District, including an ALDI’s grocery store.

Section 2. The district map in all other respects shall remain the same.

Section 3. This ordinance shall take effect upon its passage and publication as provided by law.

NOW THEREFORE BE IT FURTHER ORDAINED that the City Clerk shall provide a copy of this resolution to Planning and Development Director, Julie Anderson, of Racine County Planning and Development, located at the Ives Grove Office Complex, 14200 Washington Ave., Sturtevant, WI 53177.
