PRESENT: Amy Zott, Bill Goulding, Ron Patla, Bill
Fell and Dan Snyder.
Absent: Edna Miller.
Excused: None.
MOTION: The minutes of May 30, 2006 were approved on
a motion by Dan Snyder, seconded by Bill Fell.
CITIZEN COMMENTS: None
APPEAL: By Mark J. Mattes, on behalf
of Burlington Pharmacy, regarding the property located
at 300 S. Pine Street for a variance from Section
315-48D(2) of the zoning ordinance, which states that no
off Street parking serving more than five vehicles shall
be closer than eight feet to the side or rear lot line
of an abutting lot or parcel.
Appearing in favor of the variance
request was Mark J Mattes, Mattes Architects & Designers
8320 W. Bluemound Rd. Suite 223 Milwaukee WI. No one
appeared opposed to the variance request. The City, in
the presence of Zoning Administrator Pat Scherrer, was
in favor of granting the variance.
DISCUSSION: It was noted that the property had sat
vacant for a number of years due in part to the limits
imposed by the B-1 zoning and the constrains imposed by
the adjacent properties. It was further noted that on
both sides of the parcel are business sites and that the
green space to the front, which faces residential
parcels, would be substantially increase with the
proposed improvements. No one appeared opposed to the
granting of a variance and there clearly exists an
absence of detriment.
RULING: As this parcel complies with all other parts
of the code, and it is unlikely that a different use for
the property which would comply with the code could be
found, and as compliance with the ordinances would
unreasonably prevent the owner from using the property
for a permitted purpose, on a motion by Amy Zott,
seconded by Dan Snyder, the motion was granted
unanimously. OTHER MATTERS: None.
ADJOURNMENT: On a motion by Bill Fell, seconded by
Amy Zott, the meeting was adjourned at 5:55 pm on
Tuesday October 17, 2006.
