ZONING BOARD OF APPEALS

CALLED TO ORDER:  5:30 pm

PRESENT: Kirt Ludwig, John Maltby, Tom Wiemer, Bill Fell Dan Snyder and Bill Goulding. Absent: None.

MOTION: Copies of the minutes of the July 16, 2002 meeting were not provided.

APPEAL: Sign variance of 24 sq ft in area for Precise Orthodontics, Inc. 101 Industrial Drive by Gene Shannon, 201 Meadowlark Dr. No one appeared in favor of nor apposed to the variance request. The City stood apposed to granting the variance. The sign had been completed and placed on the building prior to the appeal.

In reviewing the filing it was noted that $100,000 of work had been completed on the building with appropriate permits and that "Signs By Tomorrow" of Kenosha had been relied upon for the sign being compliant. Further, the sign with variance, would total less than 100 sq ft and the zoning ordinances allow for a free standing sign of up to 100 sq ft per zoning lot.

RULING: As the amount of signage was not the issue but rather the need to cover the area of the prior sign the Appeal was Approved Unanimously on a motion by Bill Goulding, seconded by Tom Wiemer, with the condition that no additional signs be placed on the property.

APPEAL: Sign variance to allow a second free standing sign for Cross Lutheran Church, 126 Chapel Terrace by Bruce Peacock, 638 Meadow Lane and Eugene Albee, 957 Echo Drive. No one appeared in favor of nor apposed to the variance request. The City stood apposed to granting the variance. It was the intent of Cross Lutheran to move a portion of their existing sign to the NE corner of the intersection of Chapel Terrace and Edgewood drive.

In reviewing the filing it was noted that a new sign was approved for the NE corner of the intersection of Chapel Terrace and STH 11 and that the existing sign at that location was compliant, however if moved, would constitute a second free standing sign. Additionally, that portion of the sign to be moved was the "reader board" which gave the times of services and etc. and that became a concern of the Board with the possibility of cars slowing to read detailed information at such a busy intersection.

RULING: Taking into consideration the large lot size, with 500 ft plus between the two signs, and the fact that both would be at busy intersections, the Appeal was Approved Unanimously on a motion by John Maltby, seconded by Tom Wiemer, with the condition that the sign be an informational sign of appropriate size stating little more than the name of the church.

ADJOURNMENT: The Chair declared that the meeting was adjourned at 6:25 pm on September 17, 2002.
