ZONING BOARD OF APPEALS

CALLED TO ORDER:  5:30 pm

PRESENT: John Maltby, Tom Wiemer, Bill Fell, Dan Snyder and Bill Goulding. Absent: Kirt Ludwig.

MOTION: That the minutes of the April 16, 2002 meeting be approved was made by John Maltby, seconded by Dan Snyder, and passed.

APPEAL: Sign variance for Pinecrest Shopping Center, 156 – 240 S. Pine St. by Bob Hacker, Bauer Sign Co. Muskego, WI and Jerry Much, Pinecrest Assoc. LLC to place a free standing sign at the Pine St. entrance of Pinecrest Shopping Center. The afore mentioned appeared in favor of the variance and the City recommended that the variance request be denied.

The applicant agreed to place the sign 30 ft. back from the Pine St. right of way and to add the appropriate landscaping. Further, it was decided that the sign area of the sign in question was compliant, and that any relationship to total sign area was not an issue at this time.

RULING: In reviewing the variance request for a 25 ft height the Board took into consideration that a 15 ft sign would be blocked by the non-conforming bank sign from the south and that it would be the only free standing sign for all tenants of the shopping center. Further, the zoning ordinances do allow for a 40 ft sign for shopping centers that abut a road with an ADT of 20,000 vehicles, and though the ADT is no quite 20,000, it was taken into consideration that the request was not for a 40 ft sign. It was decided that the variance for a sign height 25 ft would be approved by a 4 to 1 vote on a motion by Bill Fell, seconded by John Maltby.

APPEAL: Sign variance for St John the Divine Episcopal Church, 216 E. Chandler Blvd. For off-sight and off- premise signs (11) which advertise an establishment and to be placed in the public right of way. Georgia Agner, 623 Browns Lake Dr. and Bob Emery, 202 200th Ave. Union Grove appeared in favor of the variance, no one appeared that was apposed, and the City recommended that the variance request be denied.

In reviewing the variance request the primary objection became the number of signs, especially if all 20 some churches in Burlington were to put up 10 or more signs. The argument in favor of granting the variance was that several churches already had in place such signs to include the United Methodist, Our Savior Lutheran, St Johns Lutheran and St John the Divine Episcopal Church. Also, it was stated that Larry Gobel, Park & Street Dept. had given his approval to place sign in the medians as they were public right of way.

RULING: It was determined that 3 of the proposed sign locations were outside of this board’s jurisdiction and the applicant agreed to withdraw their request for 6 of the remaining 8 signs. Approved unanimously on a motion by Bill Fell, seconded by John Maltby, to allow for 2 signs at the corners of S. Pine St. and Chandler Blvd.

APPEAL: Balcony variance for David Flitcroft to extend a decorative balcony approximately 12 inches into the right of way. Ryan Zenk, 804 N. Wisconsin Elkhorn, attorney for David Flitcroft and Tom Stelling, of Stelling & Assoc. 181 W. Chestnut St. appeared in favor of the variance, no one appeared to oppose the variance and the City had no opinion on this item.

RULING: As the Historical Preservation Committee, in the presence of Tom Stelling, was in favor of granting this variance and as the door to the balcony is to be permanently sealed making this a purely decorative item and there being no opposition, the Zoning Board saw no reason to deny this request. Approved unanimously on a motion by Bill Fell, seconded by John Maltby.

APPEAL: Sign variance for Burlington High School for an off-site and off-premise sign, which would advertise establishments and would be located in a public park. Dennis Spankowski appeared for and Ken Kline appeared in favor of granting the variance, no one appeared to oppose the variance and the City had no opinion on this item.

RULING: As this item had been before this board in April and had been denied due solely to incorrect posting, there was very little discussion. Approved by a 4 to 1 vote on a motion by Bill Goulding, seconded by Bill Fell.

ADJOURNMENT: The findings were read into the record and the Chair declared that the meeting was adjourned at 6:45 pm on May 21, 2002.
