Police Department Courtroom
August 8, 2006, 6:30 p.m.
Mayor Claude Lois called the Plan Commission meeting
to order this Tuesday evening at 6:30 p.m. followed by
roll call: Commissioners Bob Schulte, John Thate, Bill
Milatz, Bob Henney, and John Lynch, Jr. and Town of
Burlington Representative Hans Jansen. Commissioner
Thomas Vos arrived at 6:31 p.m. Also present were City
Administrator, David Torgler and Patrick Meehan, Meehan
& Company, Inc.
APPROVAL OF MINUTES
Commissioner Thate moved and Commissioner Schulte
seconded to approve the minutes of July 11, 2006. All
were in favor and the motion carried.
Citizen Comments – Ms. Carol Curtis, 281 Schemmer
Street voiced her concern regarding the new hospital
parking lot being constructed at 233 McHenry Street.
Mayor Lois stated that because the Plan Commission had
already approved this issue at their last meeting, any
further concerns should be raised at the Common Council
meeting on August 15, 2006.
PUBLIC HEARINGS
- A public hearing to consider a Conditional Use
Application from Sandra Miller for property located
at 6025 S. Pine Street to allow for a house call
veterinary clinic.
Mayor Lois opened the
public hearing at 6:33 p.m.
There were no comments.
Commissioner Vos moved and
Commissioner Milatz seconded to close the public
hearing. All were in favor and the motion carried. The
public hearing was closed at 6:33 p.m.
- A public hearing to consider a Conditional Use
Application from The City of Burlington Waste Water
Treatment Plant for property located at 2224 S.
Milwaukee Avenue (Town of Burlington) for a utility
shed to house odor control equipment.
Mayor Lois opened the
public hearing at 6:34 p.m.
Mayor Lois noted that only
the public hearing would be occurring at this evening’s
meeting. The conditional use issue would be brought back
before the Commission once this property has been
annexed into the City.
There were no further
comments.
Commissioner Schulte moved
and Commissioner Vos seconded to close the public
hearing. All were in favor and the motion carried. The
public hearing was closed at 6:35 p.m.
OLD BUSINESS
None.
NEW BUSINESS
- Consideration to approve Conditional Use
Application from Sandra Miller for property located
at 6025 S. Pine Street to allow for a house call
veterinary clinic, subject to Patrick Meehan’s July
31, 2006 memo to the Plan Commission.

issue for discussion.
There were no comments.
Commissioner Milatz moved
and Commissioner Vos seconded to approve a
Conditional Use Application from Sandra Miller for
property located at 6025 S. Pine Street to allow for a
house call veterinary clinic, subject to Patrick
Meehan’s July 31, 2006 memo to the Plan Commission as
follows:

Pursuant to the requirements of Section 315-48(E),
the proposed off-street parking and loading area
shall be paved with either asphalt or concrete. This
item must be addressed by the applicant and a
revised Site Plan be submitted to City staff for
review and compliance.

That no
service including the boarding of animals is offered
outside of an enclosed building.
All were in favor and the
motion carried.
- Consideration to recommend approval to the
Common Council of a rezoning request from the
Burlington Area School District to rezone 380
McCanna Parkway from M-3, Manufacturing and Office
Park District to I-1, Institutional District,
subject to the conditions as stated in Patrick
Meehan’s July 31, 2006 memo to the Plan Commission.
Mayor Lois opened this
issue for discussion.
Commissioner Vos questioned
if this property would now be taken off of the tax roll
with the new zoning. Mayor Lois noted that this property
was already off of the tax roll when it was Gateway.
Administrator Torgler further stated that the taxation
issue goes according to the business type not the
zoning.
There were no further
comments.
Commissioner Schulte moved
and Commissioner Vos seconded to recommend approval to
the Common Council of a rezoning request from the
Burlington Area School District to rezone 380 McCanna
Parkway from M-3, Manufacturing and Office Park District
to I-1, Institutional District, subject to the
conditions as stated in Patrick Meehan’s July 31, 2006
memo to the Plan Commission.
All were in favor and the
motion carried.
- Review of An Ordinance to attach property to
the City of Burlington pursuant to Wis. Stat.
Section 66.0225 and the City-Town agreement and to
permanently zone the attached land (Burlington
Consumers Cooperative, Southern Lakes United
Educators Council, Otter Sales & Service, Cerwin
Trust, Miller Motor Sales, Inc, Lancour residence
and Cottonpicker restaurant).
Mayor Lois opened this
issue for discussion and reminded the Commission that
this next phase of attachments is part of the nearly
five year old City-Town agreement that states that by
this November these commercial and non residential
properties be brought into the City.
Commissioner Vos moved and
Commissioner Henney seconded to recommend approval to
the Common Council of An Ordinance to attach property
to the City of Burlington pursuant to Wis. Stat. Section
66.0225 and the City-Town agreement and to permanently
zone the attached land (Burlington Consumers
Cooperative, Southern Lakes United Educators Council,
Otter Sales & Service, Cerwin Trust, Miller Motor Sales,
Inc, Lancour residence and Cottonpicker restaurant).
All were in favor and the
motion carried.
- Discussion of a conceptual plan to eliminate the
B-4 Highway Business District from the Municipal
Code.
Mayor Lois opened this
issue is for discussion and reminded the Commission that
the B-1 District has been amended since the creation of
the B-4 District, making it no longer necessary.
There were no comments.
Commissioner Lynch moved
and Commissioner Milatz seconded to recommend approval
to the Common Council of the elimination of the B-4
Highway Business District from the Municipal Code.
All were in favor and
the motion carried.
- Review of An ordinance setting forth
permanent zoning classifications and regulations for
property owned by The Order of the Franciscan
Fathers located at 2457 Browns Lake Drive.
Mayor Lois opened
this issue for discussion clarifying that only the small
grassy portion closet to Hwy 36 that is currently zoned
B-4 will be permanently zoned B-1.
Commissioner Miltaz moved
and Commissioner Schulte seconded to recommend approval
to the Common Council of An ordinance setting forth
permanent zoning classifications and regulations for
property owned by The Order of the Franciscan Fathers
located at 2457 Browns Lake Drive.
All were in favor and the
motion carried.
- Discussion of a conceptual plan to rezone
property located at 348 Paul Street for use as an
education outreach facility with the Burlington Area
School District (BASD).
Mayor Lois opened this
issue for discussion. It was clarified that this program
would be for the mentally handicapped and would run from
7:30 -3:30 p.m. with the students going in and out of
the building throughout the day utilizing their skills.
Commissioner Vos questioned
if the neighboring property owners had been notified of
this plan and whether this property would be rezoned to
the institutional district making it a non taxpaying
parcel. Administrator Torgler stated that the neighbors
have not been notified at this time; however they would
be notified as part of the conditional use process that
the School District would have to apply for if the
Commission approves of this plan.
Mrs. Pat Hoffman, BASD
Assistant Superintendent, informed the Commission that a
teacher did go door to door and spoke with the area
neighbors about this project. Mrs. Hoffman confirmed
that this is joint program with Waterford and Union
Grove for the developmentally handicapped students ages
18-21 to learn life skills. This new environment will
allow for better teaching of these skills that were once
taught in a traditional classroom at the high school.
Mayor Lois questioned if the program had a parking
agreement worked out. Mrs. Hoffman stated that the owner
of Visicom, who has a neighboring 52 stall lot, has
agreed to allow for BASD to use five stalls in the lot.
Ms. Hoffman also stated that this parking agreement is
in writing with this company as well as a waiver of
liability would be signed by each person that would be
parking in the lot. Mrs. Hoffman also noted that this
program’s goal would be to help these youngsters to be
as independent as possible. Commissioner Milatz
questioned how the students from Union Grove and
Waterford would be transported to the facility. Mrs.
Hoffman informed the Commission that BASD had a contract
with S&J Bus Co., Waterford, which would provide the
transportation.
Concerns were raised as to
whether this project would set a harmful precedence for
the future. Administrator Torgler stated that by doing a
text amendment to the Rd-2, Two Family Residence
District and adding this use as a conditional use it
will ensure the best monitoring of this type of program.
Mr. Patrick Meehan also noted that the other half of
this duplex will have to remain as a dwelling so it
doesn’t change the character of the Rd-2, Two Family
Residence District. Mrs. Hoffman also stated that if
this program does not work, the program would return
back into the schools.
After further discussion
was held regarding these issues, the BASD was instructed
that they would need to apply for a conditional use
permit.
- Consideration to recommend approval to the
Common Council of an Extraterritorial Final Plat for
Arbor View Communities (located on the east side of
CTH P, north of Fulton Street and south of Fish
Hatchery Road, in the Town of Burlington) subject to
the conditions as stated in Patrick Meehan’s July
31, 2006 memo to the Plan Commission.

Commissioner Lynch moved
and Commissioner Vos seconded to recommend approval to
the Common Council of an Extraterritorial Final Plat for
Arbor View Communities (located on the east side of CTH
P, north of Fulton Street and south of Fish Hatchery
Road, in the Town of Burlington) subject to the
conditions as stated in Patrick Meehan’s July 31, 2006
memo to the Plan Commission as follows:

Pursuant to the Town of Burlington’s and Racine
County’s approval of the Final Plat
-
Pursuant to the requirements of Section
236.20(3)(d), the names of adjoining streets (CTH P)
need to be underscored by a dotted or dashed line.

The exact length and
bearing of the center line of all streets needs to
be indicated on the Final Plat.
