Commissioner Thomas Vos called the Plan Commission
meeting to order this Tuesday evening at 6:30 p.m.
followed by roll call: Commissioners John Thate, John
Lynch Jr., Bill Milatz, Bob Schulte and Bob Henney.
Chairman Claude Lois was excused. Chairman Vos stated
that he would retain his right to vote. Also present
were City Administrator, David Torgler; Patrick Meehan
Meehan & Company, Inc.; Building Inspector Patrick
Scherrer; Aldermen James Beardsley; Frank Cannella; Joel
Jacobson and Robert Miller.
APPROVAL OF MINUTES
Commissioner Thate moved and Commissioner Schulte
seconded to approve the minutes of May 10, 2005. All
were in favor and the motion carried.
Citizen Comments – None.
PUBLIC HEARINGS
- A public hearing to consider a Conditional Use
Application for Lee Enterprises – Plymoth LLC (Ramesh
Kapur) to allow for a commercial office building
(office use unrelated to principle industrial
operations).
Acting Chairman Vos opened
the public hearing at 6:33 p.m.
There were no comments.
Commissioner Thate moved
and Commissioner Lynch seconded to close the public
hearing at 6:33 p.m. All were in favor and the motion
carried.
- A public hearing to consider a Conditional Use
Application for Oakland Enterprises to allow for a
retail home center (Menards); structure to exceed
60,000 square feet; building supply store; retail /
wholesale sales of electrical apparatus and
equipment; farm and garden machinery; outdoor
display of merchandise.
Chairman Vos opened the
public hearing at 6:33 p.m.
Mr. Bill Korducki, 31010
Plank Road, Town of Burlington, representative for
Riverknoll Acres Subdivision passed out a memo to the
Commission regarding several conditions that the
Riverknoll Acres Subdivision would like to work with the
potential Menards store on accomplishing. He stated that
he wished to work with the representatives from Menards
to be good neighbors and maintain the conditions stated
in the conditional use permit.
There were no further
comments.
Commissioner Milatz moved
and Commissioner Schulte seconded to close the public
hearing at 6:41 p.m. All were in favor and the motion
carried.

NEW BUSINESS
- Consideration to approve the Conditional Use
Application and Site Plan for Lee Enterprises –
Plymoth LLC (Ramesh Kapur) to allow for a commercial
office building (office use unrelated to principle
industrial operations) subject to the conditions as
stated in Patrick Meehan’s June 6, 2005 memo to the
Plan Commission.
Chairman Vos opened this
issue for discussion.
Commissioner Lynch
questioned how the bypass was going to affect this
property. Administrator David Torgler stated that this
property is just north of the bypass and would pose no
issue with the layout or construction. Mr. Torgler noted
that another engineering firm would be reviewing the
stormwater plans and they will submit their review to
City staff.

Commissioner Lynch moved
and Commissioner Thate seconded to approve the
Conditional Use Application and Site Plan for Lee
Enterprises – Plymoth LLC (Ramesh Kapur) to allow for a
commercial office building (office use unrelated to
principle industrial operations) subject to the
conditions as stated in Patrick Meehan’s June 6, 2005
memo to the Plan Commission as follows:

That the proposed parking spaces numbered 20 and 21
(a single row and aisle of 90-degree parking spaces)
which only provide for 35 total feet in width (with
only 15 feet of access drive width and not the
required 45 feet of width) will need to have a
single row and aisle of 90-degree parking spaces
with a minimum of 45 feet in width and a double row
and aisle of 90 degree parking spaces with a minimum
of 65 feet in width.

If
any outdoor lighting is contemplated to serve the
off-street parking lot, outdoor lighting data is
required which indicates location, type, and
illumination level (in footcandles) of all outdoor
lighting proposed to illuminate the site. It is
recommended that total cut-off luminaries be used
throughout the site meeting the requirements of
Sections 315-137(C)(25) of the City Zoning
Ordinance.

That all site engineering-related portions of this
project (including drainage, utility, easement,
sewer, water, and other engineering-related issues)
are deferred to the City Engineer for review and
comment.
-
That a revised Site Plan be submitted to City staff
for review for compliance with these outstanding
issues.
All were in favor and the

- Consideration to approve revisions to the Site
Plan for the Gateway Technical College located at
496 McCanna Parkway subject to the conditions as
stated in Patrick Meehan’s June 8, 2005 memo to the
Plan Commission.
Chairman Vos opened this
issue for discussion.
Mr. Mike Ciofani, Plunkett
Raysich Architects, LLP and Mr. Larry Paruszkiewicz,
Gateway Technical College, were at the meeting to answer
any questions that the Commission had. Commissioner
Lynch had questions regarding how the parking and
traffic flow would work with the High School. Mr.
Patrick Meehan, Meehan & Company, Inc. clarified that
the parking issue had already been addressed previously
and was approved by the Commission. Mr. Torgler stated
that the revisions that the Commission should be
concerned with are those noted on Pat Meehan’s
memorandum (items a-d). Commissioner Milatz questioned
how the McCanna / Hwy 142 intersection would be lighted
if it becomes a through street in the future. Mr.
Torgler stated that neither the overpass issue nor the
lighting issue have yet been finalized by the Department
of Transportation. Commissioner Milatz also questioned
if the item in City Engineer Tom Foht’s memo regarding a
permanent barricade being installed on the end of
McCanna Parkway and at the west end of the west parking
would be done as it is not shown on the plan. Mr.
Ciofani stated that it was an oversite that it was not
noted on the site plan and the barricades would be put
in. Commissioner Schulte questioned why the size of the
trees was being reduced. Mr. Paruszkiewicz stated that
Gateway has run into some budget issues and after
investigating some ways to keep the project in budget
the size of trees added to some of the savings.

Commissioner Schulte moved
and Commissioner Lynch seconded to approve the revisions
to the Site Plan for the Gateway Technical College
located at 496 McCanna Parkway subject to the conditions
as stated in Patrick Meehan’s June 8, 2005 memo to the
Plan Commission as follows:
-
The applicant’s request to reduce the size of
required landscape trees to 2" - 2.5" caliper is
denied by the Plan Commission since this proposal
does not meet the minimum size requirements of
Section 315-48(D)(6)(b) of the City Zoning
Ordinance.
-
The area (in square feet and/or acres) of the
subject property needs to be noted on the Site Plan.
-
Although the ground sign location is noted on the
Site Plan, the type and size of all signs need to be
indicated on the Site Plan.
-
The building height (in feet) of the proposed
building needs to be indicated on the Site Plan.
-
All stormwater calculations need to be submitted for
City Engineer review.
-
Proposed sanitary sewers and water mains (serving
the proposed building) need to be indicated on the
Site Plan.
-
The location of all proposed easements (properly
labeled and dimensioned) shall be submitted.
-
All of those conditions set forth in Tom Foht’s
review memo to the City of Burlington dated November
15, 2004 are applicable to the Site Plan and shall
be addressed by the applicant.
-
Per the City Engineer’s memorandum to the City of
Burlington dated December 9, 2004, a Type III
permanent barricade shall be installed at the end of
the public street. Site Plan note #19 shows the
location the barricade should be placed at. The
relocated gate is currently specified at the end of
McCanna Parkway–this should be located at the west
end of the parking lot.

The allowance of the indefinite delay in the
construction of the masonry half-height screen wall
and poured concrete "patio" on the west side of the
building. However, landscaping will be installed per
original plan, providing screening.
-
The allowance of the change in the construction of
the large curved wall from precast concrete to
stained single-scored concrete block to simulate 8"
x 8" tile due to long lead delivery concerns.
-
The omission of the brick and concrete block
enclosure at the trash dumpster pad.
-
A
revised Landscape plan must be submitted to City
staff for review.
-
The submission of revised plans to include the above
conditions for staff review.

motion carried.
- Consideration to recommend approval to the
Common Council of a Certified Survey Map (CSM) and
rezoning application for Mark Starzyk to rezone
property located at 349 W. Market Street from B-1,
Neighborhood Business District to M-1, Light
Manufacturing District subject to the conditions as
stated in Patrick Meehan’s June 3, 2005 memo to the
Plan Commission.
Chairman Vos opened this
issue for discussion.
Commissioner Milatz
questioned if Mr. Starzyk intended on tearing down the
older building. Mr. Starzyk stated that he would not be
tearing the building down, however he would be fixing
the exterior of the building. Mr. Torgler also informed
the Commissioner that this project would require front
and rear yard setback variances to make a lot of this
size work.

Commissioner Lynch moved
and Commissioner Milatz seconded to recommend approval
to the Common Council of a Certified Survey Map (CSM)
and rezoning application for Mark Starzyk to rezone
property located at 349 W. Market Street from B-1,
Neighborhood Business District to M-1, Light
Manufacturing District subject to the conditions as
stated in Patrick Meehan’s June 3, 2005 memo to the Plan
Commission as follows:
-
The Plan Commission recommends to the Common Council
that the existing Lots 2, 3, 4, 5, and the easterly
2.65 feet of Lot 6 of Block 8 of Sheldon’s First
Addition to the City of Burlington be rezoned from
the B-1 Neighborhood Business District to the M-1
Light Manufacturing District.
-
Pursuant to the requirements of Section
278-39(A)(2), all required setback lines need to be
indicated on the proposed Certified Survey Map for
both proposed Lots 1 and 2. Therefore, the B-1
District setbacks need to be indicated on the face
of the proposed Certified Survey Map for proposed
Lot 2.
-
Pursuant to the requirements of Section
278-39(A)(5), existing and proposed contours need to
be indicated. However, due to the significantly
"flat" topography of the subject property, it is
recommended that this requirement be waived by the
Plan Commission pursuant to the requirements of
Section 278-11 of the City Subdivision of Land
Ordinance.
-
That the proposed Site Plan be conditionally
approved subject to the Common Council rezoning the
subject property from the B-1 Neighborhood Business
District to the M-1 Light Manufacturing District.
-
A
variance from the Zoning Board of Appeals will need
to be applied for and granted for the new warehouse
building setback of only 26 feet from the Market
Street public right-of-way and not the required 30
feet.
-
The proposed new warehouse building is proposed to
be set back only 10 feet from the rear yard line and
not the required 25 feet. Therefore, a variance from
the Zoning Board of Appeals will need to be applied
for and granted.
-
The proposed Site Plan must indicate the width of
the entry drive and the drive width (24 feet) on a
revised Site Plan.
-
The precise location of the required off-street
parking spaces must be indicated on a revised Site
Plan.
-
That a revised Site Plan be submitted to show a
single row and aisle of 90-degree parking spaces
that need to be a minimum of 45 feet in width and a
double row and aisle of 90-degree parking spaces
needs to be a minimum of 65 feet in width.
-
A
revised Site Plan needs to be submitted to show one
of the off-street parking spaces designated for
persons with disabilities.
-
A
Landscape Plan must be submitted to the City that
indicates the location, type (by species), number,
and size of all such required landscape plant
materials.
-
The site size needs to be indicated on the Site
Plan.
-
The height of the proposed building (in feet and
stories) needs to be indicated on the Site Plan.
-
The existing and proposed topography needs to be
graphically indicated on the proposed Site Plan.
-
Off-street parking spaces need to be graphically
indicated on the proposed Site Plan.
-
A
north arrow needs to be graphically indicated on the
proposed Site Plan.
-
Proposed sanitary sewers, storm sewers, and water
mains need to be graphically indicated on the
proposed Site Plan.
-
Any proposed stormwater management facilities
including stormwater calculations need to be
submitted to the City, meeting the requirements of
the City’s stormwater management plan.
-
A
Landscape Plan is required which meets the
requirements of Section 315-138 of the City Zoning
Ordinance.
-
Architectural plans, elevations, and perspective
drawings and sketches are required to be submitted
illustrating the design, character, materials, and
dimensions of the proposed structure.
-
If
any outdoor lighting is contemplated to serve the
off-street parking lot, outdoor lighting data is
required which indicates location, type, and
illumination level (in footcandles) of all outdoor
lighting proposed to illuminate the site. It is
recommended that total cut-off luminaries be used
throughout the site meeting the requirements of
Sections 315-137(C)(25) of the City Zoning
Ordinance.

- Consideration to approve the Site Plan for
Corporate Contractors, Inc. (ABC Supply Co.) to
allow for the construction of a showroom / warehouse
at 681 S. Kane Street subject to the conditions as
stated in Patrick Meehan’s May 31, 2005 memo to the
Plan Commission.
Chairman Vos excused
himself as chairman on this issue and Commissioner Lynch
took over as chairman and opened this issue for
discussion. Mr. Torgler informed the Commission that
this project would allow ABC Supply a larger site that
better meets their needs and would provide them with
better traffic flow for their trucks as well as
relieving some of the congestion in the Industrial Park.
Commissioner Henney questioned how they would be
directing the truck traffic in this area. Mr. Tony
Taylor, manager of ABC Supply, Burlington, stated that
the supply trucks would be backing in off the first
(north) driveway and the ABC trucks would pull into the
second driveway.

Commissioner Schulte moved
and Commissioner Henney seconded to approve the Site
Plan for Corporate Contractors, Inc. (ABC Supply Co.) to
allow for the construction of a showroom / warehouse at
681 S. Kane Street subject to the conditions as stated
in Patrick Meehan’s May 31, 2005 memo and Staff Engineer
Jason Feucht’s June 8, 2005 memo to the Plan Commission
as follows:

A
note needs to be added to the Site Plan indicating
where concrete curb and gutter are to be provided at
the subject property in compliance with the
requirements of Section 315-48(F) of the Zoning
Ordinance.
-
The applicant needs to calculate and indicate on the
face of a revised Site Plan (in terms of square
feet) the total of the surfaced off-street parking
area (inclusive of both parking stalls and
associated drives) and the total landscape island
area (in terms of square feet) located within the
off-street parking area.
-
A
minimum total of two canopy trees need to be placed
within the interior of the off-street parking areas
of the proposed development.
-
A
Landscape Plan must be submitted with the revised
Site Plan.
-
Proposed sanitary sewers, storm sewers (if any), and
water mains must be noted on the Site Plan. [Note:
As currently drawn, there is no differentiation
between sewer main and/or water main.]
-
If
any outdoor lighting is contemplated to serve the
off-street parking lot, outdoor lighting data must
be submitted which indicates location, type, and
illumination level (in footcandles) of all outdoor
lighting proposed to illuminate the site. It is
recommended that total cut-off luminaires be used
throughout the site meeting the requirements of
Sections 315-137(C)(25) of the City Zoning
Ordinance.

A
notation must be added at the location of the
proposed curb cuts on the existing City curb and
gutter.
-
The existing storm sewer and catch basin(s) located
in Kane Street must be shown on a revised Site Plan.
-
The existing and proposed utilities supporting the
parcel must be shown on a revised Site Plan.
-
The inlet and outlet detail on trench drain must be
shown on a revised Site Plan.
-
The existing and proposed grades in area of proposed
pavement and green spaces where construction
activities are occurring must be shown on a revised
Site Plan.
-
The existing and proposed grade on proposed curb and
gutter must be shown on a revised Site Plan.
-
The clarifications of notes "Slope up +/- 8’-0"
Existing Green Space" and "Slope down +/- 8’-0"
Existing Green Space".
-
Proposed downspout locations must be shown on a
revised Site Plan.
-
That the proposed trench drain outlet location
design be revised so as not to add and concentrate
flows to adjacent properties.

as chairman of the meeting.

Mr. Mark Lake, Redmond
Company, and Mr. Theron Berg, Menards were at the
meeting to make a presentation regarding this issue.
Following the presentation, a discussion ensued and
there were comments from various aldermen and citizens
regarding concerns about the deviation from the code
regarding signage and parking as well as landscaping and
elevation issues and bonding issues. After further
discussion regarding the abovementioned issues it was
agreed by the Commission and by Mr. Lake and Mr. Berg
that certain revisions would be made and backup would be
supplied for those items that deviated from the City
code and would be brought back to the Commission at
their July 12, 2005 meeting.

and Commissioner Henney seconded to table the
Conditional Use Application and Site Plan for Oakland
Enterprises to allow for a retail home center (Menards);
structure to exceed 60,000 square feet; building supply
store; retail / wholesale sales of electrical apparatus
and equipment; farm and garden machinery; outdoor
display of merchandise until the July Plan Commission
meeting.
All were in favor and the
motion carried.
- Consideration to recommend approval to the
Common Council of a Certified Survey Map and
rezoning application for Oakland Enterprises to
rezone property located at 2100 Milwaukee Avenue
(Menards), which is currently zoned B-1,
Neighborhood Business District and FC, Floodplain
Conservancy with a PUD Overlay. The petitioner would
like to amend their current Planned Unit Development
agreement to expand the current commercial business
uses subject to the conditions as stated in Patrick
Meehan’s June 6, 2005 memo to the Plan Commission.

Commissioner Thate moved
and Commissioner Henney seconded to recommend approval
to the Common Council of a Certified Survey Map
rezoning application for Oakland Enterprises to rezone
property located at 2100 Milwaukee Avenue (Menards),
which is currently zoned B-1, Neighborhood Business
District and FC, Floodplain Conservancy with a PUD
Overlay. The petitioner would like to amend their
current Planned Unit Development agreement to expand the
current commercial business uses subject to the
conditions as stated in Patrick Meehan’s June 6, 2005
memo to the Plan Commission as follows:
-
Pursuant to the requirements of Section
278-39(A)(2), all required setback lines be
indicated on the proposed Certified Survey Map
including all rear and/or side yard setback lines
(with dimension note) for Lots 1 and 2.
-
Pursuant to Section 278-11 of the City Subdivision
of Land Ordinance, that the presentation of existing
and proposed contours on the CSM be waived due to
the significantly large parcel of land and since the
existing contours were already indicated on the
earlier approved CSM No. 2651.
All were in favor and the
motion carried.
- Consideration to recommend approval to the
Common Council of an Extraterritorial Certified
Survey Map for Richard F. Wieners subject to the
conditions as stated in David Torgler’s June 10,
2005 memo to the Plan Commission.
Chairman Vos opened this
issue for discussion. Mr. Torgler stated that the
applicant needs to show any existing buildings and the
setback lines on the Certified Survey Map (CSM). He also
noted that the Plan Commission could recommend this on
to the Council who could then conditionally approve the
CSM after it has been reviewed by staff.
There were no comments.
Commissioner Lynch moved
and Commissioner Henney seconded to recommend approval
to the Common Council of an Extraterritorial Certified
Survey Map for Richard F. Wieners subject to the
conditions as stated in David Torgler’s June 10, 2005
memo to the Plan Commission as follows:
-
The Certified Survey Map meeting all Racine County
Zoning Ordinance requirements.
-
The Certified Survey Map meeting the requirements of
Section 278-39(A)(1) of the City of Burlington
Subdivision of Land Ordinance by showing all
existing buildings, watercourses, drainage ditches
and other features pertinent to proper land
division.
-
The Certified Survey Map meeting the requirements of
Section 278-39(A)(2) of the City of Burlington
Subdivision of Land Ordinance by showing all
required Racine County Zoning Ordinance setback
lines.
-
The Certified Survey Map meeting the requirements of
Section 278-39(A)(2) of the City of Burlington
Subdivision of Land Ordinance by showing the entire
area contiguous to the proposed Certified Survey Map
owned or controlled by the subdivider on the
Certified Survey Map.
-
The submission to the City of Burlington of signed
certifications of the proposed Certified Survey Map
by the property owner, the Town Board of the Town of
Burlington, and the proper Racine County officials.

motion carried.
OTHER MATTERS
Commissioner Milatz questioned who put up the fencing
on the south side of Hwy 83. Mr. Torgler stated that the
land is in the Town of Burlington and under their
jurisdiction and both the Town and Racine County have no
fencing ordinance so no permit was required.

seconded to adjourn the meeting at 8:10 p.m. All were in
favor and the motion carried.
