October 16, 2007, 6:30 p.m.

On this Tuesday evening, Mayor Lois called the meeting to order at 6:30 p.m. starting with roll call. Roll Call: Robert Prailes, Peter Girolamo, Steve Rauch, Katie Simenson, Robert Miller, Kent Strong, Thomas Vos and John Thate. Also present were: Police Chief Scot Eisenhauer; Department of Public Works – Streets and Parks Supervisor Larry Gobel; Department of Public Works Utility Manager Connie Wilson; Fire Chief Dick Lodle; Building Inspector / Zoning Administrator Patrick Scherrer; Budget Officer / Treasurer Bridget Lois; Mike Timmers, Kapur and Associates Inc. and City Attorney Thomas Kircher.

Citizen Comments – Ms. Judith Schulz, 533 Milwaukee Avenue, invited the Council and the public to the Apple Harvest Days, October 19 & 20, 2007. She noted that this is great promotion for the downtown businesses and historic downtown.

Mr. Justin Brown, 484 McHenry Street, informed the Council that there have recently been several issues that have arose at the City dog park. He explained that several area residents have formed a committee to help in solving these issues. He stated that this committee holds public meetings on the third Tuesday of every month at 7:00 p.m. at the Library. Mayor Lois noted that he has only heard good comments about the dog park. Alderman Miller questioned the purpose of the committee. Mr. Brown explained that the purpose of the committee is to aid in making the dog park better.

Approval of Minutes – Alderman Girolamo moved and Alderman Vos seconded to approve the minutes of October 2, 2007. All were in favor and the motion carried.

Ordinance 1843(16) – Mayor Lois and the City Council gave consideration to an Ordinance amending the Official Traffic Map to create a school crossing on McCanna Parkway. Department of Public Works – Streets and Parks Supervisor Larry Gobel explained that the first course of action would be to try to install bright yellow signs at the crosswalks to alert drivers.

Alderman Vos voiced his concern regarding the awful traffic situation on this road and at the intersection of Hwy W. Mr. Gobel explained that the Department of Transportation (DOT) has been working on sections of this area from Main Street to the Bypass regarding traffic patterns, counts, etc. He noted that once the DOT is finished with their studies, that section of Hwy 11 & W would no longer be part of the state highway, but be part of the county system.

This issue will move forward to the November 6, 2007 City Council meeting for consideration.

Discussion to potentially repeal Ordinance 1203(25) – Mayor Lois and the City Council gave consideration to potentially repealing Ordinance 1203(25), "An Ordinance to amend the General Ordinances of the City of Burlington, Wisconsin", regarding the issuance of soda licenses in the City. Wisconsin State Statute 66.0433(2) required the Common Council to grant Soda Water Beverage Licenses as defined in State Statue 97.34(1)(b) prior to issuance. The City’s current practice has been to accept the completed application with the five dollar fee and issue the license at that time without the application being sent neither to the Police Department for a background check nor to the City Council for approval. As the City is not required to adopt this statute, however, it would be in the City’s best interest to repeal the ordinance. Adopting the licensing statute would allow the immediate issuance of the license, which would save on time and the need for background checks.

Resolution 4169(64) – Mayor Lois and the City Council gave consideration to a resolution approving Contract Change Order Number One for a reduction of the contract price in the amount of $24,250.99 for the pump house construction project for Municipal Well #11. The City recently discovered that as construction proceeded on the pump house building for Well #11, it was determined that several items were not needed as originally planned for in the original contract. The items included rebar for the concrete vault, change of the ceiling and door fire rating, material change to the booster pump cans, material change for the overhead door, dewatering for the installation of the pump vault, material changes for the roof hatches, size modifications of the roof hatch and double doors and finally, stone, seed, fertilizer and mulch around the reservoir tank.

This issue will move forward to the November 6, 2007 City Council meeting for consideration.

Resolution 4170(65) – Mayor Lois and the City Council gave consideration to a resolution approving Contract Change Order Number Two for a reduction of the contract price in the amount of $11,167.25 for the reservoir construction project for Municipal Well #11. As determined in Change Order Number One (Resolution 4169(64), when construction was underway on the reservoir for Well #11, it was determined that several items were not needed as originally planned for in the original contract. The items included the site grading work, the overflow splash pad, labor to sterilize the tank and about a ton of structural fill.

This issue will move forward to the November 6, 2007 City Council meeting for consideration.

Motion 07-570 – Mayor Lois and the City Council gave consideration to a recommendation from the Historic Preservation Commission (HPC) to approve a Certificate of Appropriateness for property located at 100-108 W. Chestnut Street and 501 Milwaukee Avenue to allow for the painting of the façade of the building.

This issue will move forward to the October 16, 2007 City Council meeting for consideration.

Motion 07-571 – Mayor Lois and the City Council gave consideration to a recommendation from the Historic Preservation Commission (HPC) to approve a Certificate of Appropriateness for property located at 140 W. Chestnut Street to allow for the installation of painted wood panels below the storefront windows and install molding around these panels.

This issue will move forward to the October 16, 2007 City Council meeting for consideration.

Motion 07-572 – Mayor Lois and the City Council gave consideration to a recommendation from the Historic Preservation Commission (HPC) to approve a Sign Permit for property located at 124 E. Chestnut Street to allow for the replacement of the existing exterior sign.

This issue will move forward to the October 16, 2007 City Council meeting for consideration.

Motion 07-573 – Mayor Lois and the City Council gave consideration to a recommendation from the Historic Preservation Commission (HPC) to approve a Sign Permit for property located at 516 Mill Street to allow for the replacement of the existing sign.

Motion 07-574 – Mayor Lois and the City Council gave consideration to a motion accepting an Airport Hangar Lease between the City of Burlington and William H. Wagner, located at 972 Bravo Taxiway, for a term of 29 years.

This issue will move forward to the October 16, 2007 City Council meeting for consideration.

Motion 07-575 – Mayor Lois and the City Council gave consideration to a motion accepting an Airport Hangar Lease between the City of Burlington and Bob Davis and Michele Buchenot, located at 1416 Mike Taxiway, for a term of 29 years.

This issue will move forward to the October 16, 2007 City Council meeting for consideration.

Motion 07-576 – Mayor Lois and the City Council gave consideration to a motion accepting an Assignment Agreement between Robert Davis and M & I Bank for an Airport Hangar Lease at 1416 Mike Taxiway. This agreement is an assignment of the tenant’s right to collateralize their loan for hangar improvements.

This issue will move forward to the November 6, 2007 City Council meeting for consideration.
