On this Tuesday evening, Mayor Lois called the meeting to order at 7:47 p.m. starting with roll call. Roll Call: Thomas Vos, Robert Prailes, Peter Girolamo, Steve Rauch, Katie Simenson, Robert Miller, Kent Strong and John Thate. Also present were: Police Chief Scot Eisenhauer; Department of Public Works – Streets and Parks Supervisor Larry Gobel; Department of Public Works Utilities Supervisor Dick Pieters; Budget Officer / Treasurer Bridget Lois; Fire Chief Dick Lodle; Library Director Gayle Falk; City Engineer Tom Foht, Kapur and Associates, Inc; Linda Fellenz of Kapur & Associates, Inc.; City Administrator David Torgler; Interim City Administrator Mark Morien; City Attorney Thomas Kircher and Building Inspector Patrick Scherrer.

Citizen Comments –Mayor Lois presented Administrator David Torgler with a plaque from the City of Burlington recognizing his nearly eight years of service.

Chamber of Commerce Representative – Mr. Craig Faust, Chamber Representative, informed the Council of the Chamber’s Annual Street Dance on August 16, 2007.

Approval of Minutes –Alderman Girolamo moved and Alderman Rauch seconded to approve the July 17, 2007 minutes. All were in favor and the motion carried.

Letters and Communications – None.

REPORTS BY ALDERMANIC REPRESENTATIVES AND DEPARTMENT HEADS

Police Chief Scot Eisenhauer informed the Council of some recent promotions within the Police Department. He stated that both John Fischer and Mark Anderson have been promoted to the position of Sergeant. He also noted that the Lieutenant promotion will be posted in the coming weeks as well as the hiring of two additional officers who will be starting before the end of August.

Library Director Gayle Falk informed the Council that the proceeds from the recent book sale were over $3,000 for the library.

PAYMENT OF VOUCHERS

Alderman Miller moved and Alderman Vos seconded to approve pre-paids in the amount of $43,788.79 on July 19, 2007 and $50,869.93 on July 26, 2007 totaling $94,658.72 and vouchers in the amount of $216,995.91 on August 7, 2007 for a grand total of $311,654.63. There were $317.65 in Reimbursements on July 19, 2007 and Debit Card purchases in the amount of $65.95 and $65.94 for the Police Dept.; $59.88 and $79.84 for the Library. Roll Call: Ayes: Strong, Prailes, Simenson, Rauch, Girolamo, Miller, Vos and Thate. Nays: None. All were in favor and the motion carried.

Alderman Vos moved and Alderman Girolamo seconded to approve the licenses and permits as presented. All were in favor and the motion carried.

PUBLIC HEARINGS

  1. A public hearing to consider a proposed amendment to the sanitary sewer service area for the Burlington area.

Mayor Lois opened the public hearing at 7:55 p.m.

Ms. Michelle Smith, 33615 Dream Street, Town of Burlington, voiced her concern regarding the lack of information that was given to the Town residents regarding this issue as well as who was representing the Town of Burlington on this matter. Mr. Tim McCauley, SEWRPC clarified that when an amendment like this takes place the City and Town Boards are informed and it is up to them as to how the public is informed. Ms. Smith also questioned if by doing this amendment, would it force the surrounding residents to connect to City sewer. Mayor Lois stated that the City would not or could not force anyone to connect to the City sewer. Mr. McCauley wanted to clarify that this issue has nothing to do with annexation. He explained that the purpose of the amendment is to establish a boundary so that at some point in the future if sewers are provided in those areas they would be compliant with the Clean Water Act.

Mr. Mark Otterson, 33820 Yahnke Road, Town of Burlington questioned who paid for the sewer that would be going into the new Schaefer development. Mayor Lois clarified that it would be paid for by the developer.

There were no further comments.

Alderman Miller moved and Alderman Vos seconded to close the public hearing. All were in favor and the motion carried. The public hearing was closed at 8:10 p.m.

RESOLUTIONS INTRODUCED

  1. A resolution supporting libraries in Racine County.
  1. A resolution approving a Jurisdictional Transfer Agreement between the Wisconsin Department of Transportation and Racine County and the City of Burlington.

  2. A resolution approving a Jurisdictional Transfer Agreement between the Wisconsin Department of Transportation and the City of Burlington.

  3. A resolution approving a Connecting Highway Change Agreement between the Wisconsin Department of Transportation and the City of Burlington.
  1. A resolution approving Contract Change Order Number One for the 2007 Street and Sidewalk Improvement Program – reconstruction of the watermain on STH 83, for the not-to-exceed amount of $11,200.00.

Alderman Vos requested a second reading of Resolution No. 31, A resolution supporting libraries in Racine County. Alderman Vos moved and Alderman Thate seconded to adopt Resolution No. 31. Roll Call: Ayes: Strong, Prailes, Simenson, Girolamo, Rauch, Miller, Vos and Thate. Nays: None. All were in favor and the motion carried.

Alderman Strong requested a second reading of Resolution No. 33, A resolution approving a Jurisdictional Transfer Agreement between the Wisconsin Department of Transportation and Racine County and the City of Burlington. Alderman Vos requested a second reading of Ordinance No. 9, An ordinance annexing territory located at 6730 S. Pine Street (Brown) to the City of Burlington, Wisconsin. Alderman Vos moved and Alderman Strong seconded to adopt Ordinance No. 9. Roll Call: Ayes: Strong, Prailes, Simenson, Girolamo Rauch, Miller, Vos and Thate. Nays: None. All were in favor and the motion carried.

Alderman Vos requested a second reading of Ordinance No. 10, An Ordinance annexing territory located at 32435 Yahnke Road (Schaefer) to the City of Burlington, Wisconsin. Alderman Vos moved and Alderman Rauch seconded to adopt Ordinance No. 10. Roll Call: Ayes: Strong, Prailes, Rauch, Miller, Vos and Thate. Nays: Simenson and Girolamo. The majority was in favor and the motion carried.

MOTIONS

07-557 A Motion to consider of a Certificate of Appropriateness for property located at 340 N. Pine Street, within the Historic Preservation District. Alderman Vos moved and Alderman Strong seconded to approve Motion 07-557. All were in favor and the motion carried.

OTHER MATTERS

Alderman Vos questioned who is responsible for mowing the median strips all the way out to Wal-Mart. Department of Public Works – Streets and Parks Supervisor Larry Gobel stated that the County is responsible for mowing the median and they did mow that section late last week.
