On this Tuesday evening, Mayor Lois called the meeting to order at 6:53 p.m. starting with roll call. Roll Call: Thomas Vos, Robert Prailes, Steve Rauch, Peter Girolamo, Katie Simenson, Robert Miller, Kent Strong and John Thate. Also present were: Police Chief David Walsh; Police Dept. Lieutenant Scot Eisenhauer; Department of Public Works – Streets and Parks Supervisor Larry Gobel; Department of Public Works – Utility Manager Connie Wilson; Budget Officer Bridget Lois; Fire Chief Dick Lodle; Library Director Gayle Falk; City Attorney Thomas Kircher and Building Inspector Patrick Scherrer.

Citizen Comments – Ms. Kristen Schultz, Western Racine County Health Department, was present at this evening’s meeting to go over the health concerns and risks that could happen with the arrival of the proposed Walker Bros. Circus. She informed the Council that there have been several events throughout the City recently that involved animals and many of the applicants are unaware that they need to have a permit from the USDA. As far as the upcoming circus, they would need the USDA permit as well as approval from the Wisconsin Department of Agriculture. Ms. Schultz asked if the City could modify their approval process to include the Health Dept. to allow them to keep a better eye on any potential situations with animals, sanitation and liability. Mayor Lois noted that the City would amend their application to include a review from the Health Department prior to any issues going before the Council in the future.

Chamber of Commerce Representative – None.

Approval of Minutes –Alderman Girolamo moved and Alderman Strong seconded to approve the June 5, 2007 minutes. All were in favor and the motion carried.

Letters and Communications – None.

REPORTS BY ALDERMANIC REPRESENTATIVES AND DEPARTMENT HEADS

Alderman Simenson wanted to applaud Mr. Gobel and Chief Walsh for their efforts in efficiently getting the issues taken care of that she had recently brought forward.

Chief Walsh informed the Council that the radar trailer has been out and about in the City and is a very effective way to get residents to slow down. He noted that if anyone has an area of concern to contact the Police Department and it can be set up.

Department of Public Works – Streets and Parks Supervisor Larry Gobel, informed the Council that the U S Cellular tower is now up with just the utilities and the fencing around the building yet to be put up.

PAYMENT OF VOUCHERS

Alderman Miller moved and Alderman Vos seconded to approve pre-paids in the amount of $60,223.10 on June 6, 2007 and $57,238.08 on June 13, 2007 totaling $117,461.18 and vouchers in the amount of $546,037.34 on June 19, 2007 for a grand total of $663,498.52. There were $0.00 in Reimbursements and Debit Card purchases. Roll Call: Ayes: Strong, Prailes, Rauch, Simenson, Girolamo, Miller, Vos and Thate. Nays: None. All were in favor and the motion carried.

PUBLIC HEARINGS

A Public Hearing to consider rezoning 588 Milwaukee Avenue from P-1, Park District to I-1, Institutional District to allow for the expansion and remodeling of the existing Veteran’s Memorial building.

Mayor Lois opened the public hearing at 7:03 p.m.

There were no comments.

Alderman Miller moved and Alderman Vos seconded to close the public hearing. All were in favor and the motion carried. The public hearing was closed at 7:04 p.m.

RESOLUTIONS INTRODUCED

  1. An Amended Resolution accepting a unanimous petition for direct annexation of the Robert E. Brown property at 6730 S. Pine Street in the Town of Burlington, Racine County, Wisconsin.

  2. An Amended Resolution accepting a unanimous petition for direct annexation of the Francis and Helen Schaefer property at 32435 Yahnke Road in the Town of Burlington, Racine County, Wisconsin.
  1. A Resolution approving Change Order 1 for the reservoir for Municipal Well #11 construction project for the amount of $745.00.

Alderman Miller requested a second reading of Resolution No. 7, An amended resolution accepting a unanimous petition for direct annexation of the Robert E. Brown property at 6730 S. Pine Street in the Town of Burlington, Racine County, Wisconsin. Alderman Miller moved and Alderman Rauch seconded to adopt Resolution No. 7. Roll Call: Ayes: Strong, Prailes, Rauch, Simenson, Girolamo, Miller, Vos and Thate. Nays: None. All were in favor and the motion carried.

Alderman Vos requested a second reading of Resolution No. 8, An amended resolution accepting a unanimous petition for direct annexation of the Francis and Helen Schaefer property at 32435 Yahnke Road in the Town of Burlington, Racine County, Wisconsin. MOTIONS

07-542

A motion approving the partial closure of Maryland Avenue for the Annual Tri-County Riders Toy Run. Alderman Vos moved and Alderman Girolamo seconded to approve Motion 07-542. All were in favor and the motion carried.

07-543

A motion approving a Certificate of Appropriateness for property located at 256 E. Chestnut Street, within the Historic Preservation District.

07-544 A motion approving a Certificate of Appropriateness for property located at 557 N. Pine Street, within the Historic Preservation District.

Alderman Girolamo moved and Alderman Miller seconded to approve Motions 07-543 and 07-544. All were in favor and the motion carried.

OTHER MATTERS

Alderman Vos stated that he has had several residents questioning the status of the "twin towers" on Bridge Street. He inquired if the City has been paid for the land. Administrator Torgler confirmed that the City has been paid for the land. Building Inspector Patrick Scherrer stated that they have two years to complete the exterior shell of the building and one year to complete the interior. Alderman Vos also questioned what would happen to the towers if the land reverted back to the City. Administrator Torgler stated that if that were to occur, the Community Development Authority would make that decision.

ADJOURN INTO CLOSED SESSION

Mayor Lois entertained a motion to enter into closed session pursuant to Wis. Stats 19.85(1)(c) Considering employment, promotion, compensation or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility. Alderman Miller moved and Alderman Girolamo seconded to enter into closed session at 7:17 p.m. Roll Call: Ayes: Strong, Prailes, Rauch, Simenson, Girolamo, Miller, Vos and Thate. Nays: None. All were in favor and the motion carried.

RECONVENE INTO OPEN SESSION

Alderman Vos moved and Alderman Girolamo seconded to reconvene into open session at 7:25 p.m. Roll Call: Ayes: Strong, Prailes, Rauch, Simenson, Girolamo, Miller, Vos and Thate. Nays: None. All were in favor and the motion carried.
