On this Tuesday evening, Mayor Lois called the
meeting to order at 7:07 p.m. starting with roll call.
Roll Call: Kent Strong, Thomas Vos, Robert Miller, Peter
Girolamo, and John Thate. Aldermen Joel Jacobsen, John
Ekes and James Beardsley were excused. Also present
were: City Administrator, David Torgler; Department of
Public Works Utility Manager, Connie Wilson; Department
of Public Works Utilities Supervisor, Dick Pieters;
Department of Public Works – Streets and Parks
Supervisor, Larry Gobel; Police Chief, David Walsh; Fire
Chief, Dick Lodle; Library Director, Gayle Falk; City
Attorney, Thomas Kircher; Kapur & Associates, Tom Foht
and Building Inspector, Patrick Scherrer.
Citizen Comments – None.
Chamber of Commerce Representative – No report.
Approval of Minutes –Alderman Vos moved and
Alderman Strong seconded to approve the minutes of
October 3, 2006. All were in favor and the motion
carried.
Letters and Communications – Alderman Girolamo
moved and Alderman Vos seconded to approve Communication
1 regarding Alderman Beardsley’s excused absence from
this evening’s meeting; Communication 2 regarding
Alderman Ekes’ excused absence from the evening’s
meeting and Communication 3 regarding Alderman
Jacobsen’s excused absence from this evening’s meeting.
All were in favor and the motion carried.
REPORTS BY ALDERMANIC REPRESENTATIVES
AND DEPARTMENT HEADS
Larry Gobel, Department of Public Works – Streets and
Parks Supervisor, informed the Council that crews worked
late the night of October 16, 2006 to tie in sanitary
and storm sewer at the Milwaukee Avenue / Commerce
Street intersection. He explained that there was some
difficulty in getting this accomplished, however, by
early the morning of October 17, 2006 it was completed.
Police Chief David Walsh, informed the Council that
Sergeant Scott Molitor celebrates 30 years serving the
City.
Connie Wilson, Department of Public Works Utility
Manager, informed the Council that today she received
approval from the Department of Natural Resources (DNR)
of the Wastewater Treatment Plant additions and
modifications as proposed.
REPORTS
Alderman Thate moved and Alderman Miller seconded to
receive and accept reports 1-6. All were in favor and
the motion carried. (These reports are on file at City
Hall for viewing.)
PAYMENT OF VOUCHERS
Alderman Miller moved and Alderman Thate seconded to
approve pre-paids in the amount of $16,686.36 on October
11, 2006. Roll Call: Ayes: Strong, Girolamo, Miller, Vos
and Thate. Nays: None. All were in favor and the motion
carried.
LICENSES AND PERMITS
Alderman Miller moved and Alderman Vos seconded to
approve the licenses and permits as presented. All were
in favor and the motion carried.

APPOINTMENTS

PUBLIC HEARINGS
- A public hearing to consider amending sections
of the Zoning, Subdivision of Land, and Parks and
Public Areas chapters of the Code of the City of
Burlington to align with State and FEMA mandated
floodplain provisions.
Mayor Lois opened the
public hearing at 7:12 p.m.
There were no comments.
Alderman Miller moved and
Alderman Vos seconded to close the public hearing. All
were in favor and the motion carried. The public hearing
was closed at 7:13 p.m.
- A public hearing to consider amending Chapter
315, Zoning, of the Code of the City of Burlington
to eliminate the B-4, Highway Business District and
to rezone the parcels zoned B-4 to B-1, Neighborhood
Business District.
Mayor Lois opened the
public hearing at 7:13.
There were no comments.
Alderman Miller moved and
Alderman Strong seconded to close the public hearing.
All were in favor and the motion carried. The public
hearing was closed at 7:14 p.m.
- A public hearing to consider amending Section
315-140, "Word Usage and Definitions" and Section
315-21C, "Rd-2, Two-Family Residence District" of
Chapter 315, "Zoning" of the City of Burlington
Municipal Code adding "Residential-based Public
Education Outreach Center" use as a conditional use
in the Rd-2, Two-Family Residence District.
Mayor Lois opened the
public hearing at 7:15 p.m.
There were no comments.
Alderman Vos moved and
Alderman Miller seconded to close the public hearing.
All were in favor and the motion carried. The public
hearing was closed at 7:16 p.m.
RESOLUTIONS INTRODUCED

A resolution to approve the
acceptance of a watermain easement from the Spring
Brook Landing Subdivision.

A resolution to approve the
rejection of all bids for the construction of a
reservoir for Well No. 11.
RESOLUTIONS ADOPTED
Alderman Vos requested a second reading of Resolution
No. 34, A resolution to approve the acceptance of a
watermain easement from the Spring Brook Landing
Subdivision. Alderman Vos moved and Alderman Miller
seconded to adopt Resolution No. 34. Roll Call: Ayes:
Strong, Girolamo, Miller, Vos, and Thate. Nays: None.
All were in favor and the motion carried.
Alderman Miller requested a second reading of
Resolution No. 36, A resolution to approve the
rejection of all bids for the construction of a
reservoir for Well No. 11. Alderman Miller moved and
Alderman Girolamo seconded to adopt Resolution No. 36.
Roll Call: Ayes: Strong, Girolamo, Miller, Vos, and
Thate. Nays: None. All were in favor and the motion
carried.
ORDINANCES INTRODUCED
- An Ordinance amending Section 315-140, "Word
Usage and Definitions" and Section 315-21C, "Rd-2,
Two-Family Residence District" of Chapter 315,
"Zoning" of the City of Burlington Municipal Code
adding "Residential-based Public Education Outreach
Center" use as a conditional use in the Rd-2,
Two-Family Residence District.
ORDINANCES ADOPTED
Alderman Vos requested a second reading of Ordinance
No. 15, An Ordinance amending Section 315-140, "Word
Usage and Definitions" and Section 315-21C, "Rd-2,
Two-Family Residence District" of Chapter 315, "Zoning"
of the City of Burlington Municipal Code adding
"Residential-based Public Education Outreach Center" use
as a conditional use in the Rd-2, Two-Family Residence
District. Alderman Vos moved and Alderman Strong
seconded to adopt Ordinance No. 15. Roll Call: Ayes:
Strong, Girolamo, Miller, Vos, and Thate. Nays: None.
All were in favor and the motion carried.
OTHER MATTERS
Alderman Girolamo questioned the status of the impact
fee study. Administrator Torgler stated that it is still
being worked on and the Council would be updated when
further information is completed.
Alderman Vos questioned what the City’s outlay
account status was regarding the Commerce Street
project. Administrator Torgler stated that he had a
spreadsheet that he would share with the Council at the
upcoming budget meeting.
Alderman Strong questioned the status of the Time
Warner Cable contract. Attorney Tom Kircher informed the
Council that revisions that resulted from the Council’s
discussions had just been received from Time Warner
Cable and needed to be reviewed by the City.
Administrator Torgler noted that with the demands of the
budget, he would not be able to go over those revisions
until sometime in November. He noted that the Council
would be updated as soon the review process was
completed.
ADJOURNMENT
Alderman Miller moved and Alderman Thate seconded to
adjourn the meeting at 7:23 p.m. All were in favor and
the motion carried.
The Common Council was immediately reconvened by
Mayor Claude Lois at 7:24 p.m. with the intention of
approving vouchers that were not approved during this
evening’s meeting. Due to the omission of information to
council members, the approval was postponed to the
Budget Meeting on Monday, October 23, 2006 at 5:00 p.m.
Alderman Thate made a motion to adjourn the meeting with
Alderman Strong seconding the motion. With all in favor,
the motion carried and the meeting was adjourned at 7:26
p.m.
