Special Meeting
August 17, 2004 at 5:30 P.M.

City Administrator David Torgler called the meeting
of the Community Development Authority to order at 5:30
p.m. Roll Call: Ms. Carol Anderson, Mayor Claude Lois,
Robert Miller, Jim Peterson, Bil Scherrer, Chairman Ken
Jaeger and Vice Chairman Jim Spiegelhoff were absent.
Administrator Torgler asked for a nomination for
Chairman of the meeting, as Chairman Jaeger was absent.
Commissioner Peterson moved and Commissioner Miller
seconded to appoint Mayor Claude Lois as Chairman. All
were in favor and the motion carried.
Minutes
Commissioner Miller motioned and Commissioner
Scherrer seconded to approve the minutes from the July
1, 2004 minutes. All were in favor and the motion
carried.

New Business
Task Order Number Nine – Chairman Lois
reviewed a task order for environmental services to
prepare a Petroleum Environmental Cleanup Fund Act (PECFA)
reimbursement claim for the former Wanasek Property
located at 372 S. Pine Street.
Ms. Francesca Bumpurs of the Racine County Economic
Development Corporation (RCEDC) gave a brief overview of
the PECFA program and its requirements. Ms. Bumpurs
explained that Kapur and Associates, Inc. have submitted
Task Order No. Nine, which is for the preparation and
submission of a PECFA reimbursement claim regarding the
former Wanasek property. It was explained that it is
being submitted at this time, nearly a year later, due
to the time required to determine if a PECFA claim would
be of financial interested to the City. It was explained
that the City had received notice from the State in 2003
that this parcel was eligible for PECFA reimbursement,
and that the RCEDC staff, along with Ms. Linda Fellenz
of Kapur and Associates, Inc. began compiling the
necessary documentation to determine if enough was spent
to justify the expense associated with the filing a
claim. Additional time was required to compile this
information regarding eligibility, as Kapur and
Associates, Inc. was not the initial consultant and all
of the files were not at hand. It was noted that
approximately $19,000 had been expended, therefore
justifying the cost of the claim.
Ms. Linda Fellenz of Kapur and Associates, Inc. then
explained how the claim process has progressed for this
property, as well as the required documents involved.
She further explained that there would likely be a
savings (by approximately one third) with regard to the
proposed $1,800 for the preparation of the claim, due to
the fact that many of the documents were available at
the City. Ms. Fellenz went on to explain the claim
process, noting that it is anticipated that the City
would get back approximately $15,000.
Commissioner Scherrer moved and Commissioner Peterson
seconded to approve Task Order Number Nine with Kapur
and Associates for environmental services to prepare a
PECFA reimbursement claim regarding the former Wanasek
Property located at 372 S. Pine Street for the
not-to-exceed amount of $1,805.00. Roll Call: Ayes:
Anderson, Lois, Miller, Peterson and Scherrer. Nays:
None. All were in favor and the motion carried.
Tax Incremental Fund Legislation Update – City
Administrator, David Torgler, updated the Community
Development Authority (CDA) members on the new Tax
Incremental Finance (TIF) legislation and the impact it
will have on Burlington’s Tax Incremental (TIF)
Districts.
Other Matters– None.
Commissioner Miller motioned and Commissioner
Scherrer seconded to adjourn. All were in favor and the
meeting adjourned at 5:47 p.m.
