REGULAR MEETING
POLICE DEPARTMENT COURT ROOM
AUGUST 8, 2002, 6:30 P.M.
Chairman Ken Jaeger called the regular meeting of the
Community Development Authority to order at 6:30 p.m.
starting with roll call. Roll Call: Mr. Bil Scherrer,
Alderman Robert Miller, Mayor Claude Lois and Ken
Jaeger. Mr. Jim Spiegelhoff, Mr. Jim Peterson and Ms.
Lynn Gruenke were excused. Also attending were City
Administrator David Torgler, RCEDC Representative Ms.
Jenny Trick, Aldermen Tom Vos, Frank Cannella, John Ekes
and Hydro Geologist, Linda Fellenz of Kapur and
Associates, Inc.
MINUTES
Mayor Claude Lois motioned and Mr. Bil Scherrer
seconded to approve the minutes of July 11th
and July 24th, 2002. All were in favor and
the motion carried.
OLD BUSINESS
None.
NEW BUSINESS
A. Motion to Approve Notice of Award – Hydro
Geologist Linda Fellenz of Kapur and Associates, Inc.
discussed with the Community Development Authority (CDA)
members, the backgrounds on the low bidders for the
"Asbestos Abatement and Building Demolition for 320 West
Chestnut Street and 140 – 142 E. Jefferson Street"
project. Ms. Fellenz noted that there were eight bids
total and that the three lowest bidders were Tyler
Company, Wisconsin Wrecking and Azarian Wrecking, Inc.
She stated that upon completion of background and
reference checks (on file at City Hall) that Kapur and
Associates’ recommendation was to award the bid to the
second lowest bidder, Azarian Wrecking, Inc. (The lowest
bidder was Wisconsin Wrecking). She also presented an
addendum to the original recommendation dated August 6,
2002, stating that the addendum did not change their
original recommendation.
Mr. Tom Gerovac of Wisconsin Wrecking addressed the
CDA members regarding Azar’s (aka Azarian Wrecking)
trench accident that took place in a yard, noting that
it was a fatality; and that there was also a second
fatality where a man was crushed.
He further noted that Wisconsin Wrecking has a
three-man crew, and that there would also be
subcontractors. He also addressed Onyx Environmental, a
subcontractor used by Wisconsin Wrecking, noting that
they could use a different subcontractor that the City
would be comfortable with. He also stated that they had
a bid bond. He further stated that they did not feel the
Bel-Mur project would be a problem at all.
Mr. Steve Cagel of the Wisconsin Committee on
Occupational Safety and Health (WisCOSH)
spoke to the CDA regarding Onyx Environmental’s
violations. He noted that they had an extensive number
of serious violations, and voiced concerns regarding
proper disposal of asbestos for this project, especially
since it is located in a neighborhood.
Mayor Claude Lois motioned and Alderman Robert Miller
seconded to reject the low bid in the amount of
$447,215.00. Roll Call: Ayes: Bil Scherrer, Robert
Miller, Claude Lois, Ken Jaeger. Nays: None. All were in
favor and the motion carried.
Mayor Claude Lois motioned and Alderman Robert Miller
seconded to award the bid to Azarian Wrecking, Inc. in
the amount of $448,900.00 based on the engineer’s (Kapur
and Associates, Inc.) recommendation to award the bid to
Azarian Wrecking, Inc. Roll Call: Ayes: Robert Miller,
Claude Lois, Ken Jaeger and Bil Scherrer. Nays: None.
All were in favor and the motion carried.
B. Draft Escrow Agreement – Mr. David Wagner of
Ehler’s and Associates gave a presentation to the CDA
members regarding an amended draft Escrow Agreement and
supporting data relating to potential Escrow Agents. He
stated that per the CDA’s direction, he obtained quotes
from two local vendors as well as Associated Trust (who
last handled this for the City – as well as being the
CDA’s bond trustee). Mr. Wagner reviewed his findings
with the CDA and gave a recommendation to forward the
draft escrow documents, with the inclusion of First
Banking Center as the escrow agent, to the City Council
for a first reading at it’s next meeting. He further
explained that this would allow time for adoption at the
first September City Council meeting and funding the
escrow prior to the September 29, 2002 Tax Incremental
Fund (TIF) expenditure deadline.
He further noted that he expects to provide a more
precise report the week of August 26, 2002.
C. Escrow Agent Recommendation – Mr. Wagner
presented the CDA with an amended Escrow Agreement
(amended to represent current need) per their direction
at the July 24, 2002 CDA meeting.
Mayor Claude Lois motioned and Mr. Bil Scherrer
seconded a motion to recommend to the Common Council,
approval of the adoption of the resolution and draft of
the Escrow Agreement naming First Banking Center of
Burlington as Escrow Agent, as recommended by Ehler’s
and Associates, Inc. Roll Call: Ayes: Mayor Claude Lois,
Ken Jaeger, Bil Scherrer and Robert Miller. Nays: None.
All were in favor and the motion carried.
D. Hillside Auto – City Administrator David
Torgler updated the CDA on the status of Hillside Auto
located at 80 McHenry Street. Mr. Torgler stated that as
part of the TIF project, there was a hazardous
elimination project for the intersection of Milwaukee
Avenue – McHenry Street – Amanda Street and Jefferson
Street. After reviewing past efforts regarding this
property, Mr. Torgler discussed the issue at hand, which
was whether or not to purchase the Hillside Auto
property. He also discussed the possible use of the
property as a parking lot, as well as possible future
use of the property as part of a solution for the
hazardous intersection. After much discussion, it was
decided to put this issue on the "wish list" for future
consideration.
OTHER MATTERS
Chairman Jaeger noted that the Bel-Mur building in
now vacated, and that the money has been paid.
Alderman Frank Cannella asked if the building would
be secured soon. It was indicated that it would be.
Alderman Thomas Vos asked if the award of the bid to
Azarian needed to be referred to the City Council for
action. Mr. Torgler explained that it did not.
Alderman Vos also asked when Azarian Wrecking would
start up. Mr. Torgler explained that they would be given
a Notice to Proceed, however a start date has not been
set up yet.
Alderman Thomas Vos inquired as to the status of the
Harmony Homes project. Mayor Lois and City Administrator
David Torgler briefly updated the CDA on the current
status.

Alderman Robert Miller motioned and Mayor Claude Lois
seconded to adjourn the meeting. All were in favor and
the meeting adjourned at 7:40 p.m.
