SPECIAL MEETING

AMENDED MINUTES

DECEMBER 13, 2001

5:30 P.M.

The meeting of the Community Development Authority was delayed due to a lack of quorum. At 5:35 p.m. Chairman Eckola arrived and the meeting was called to order with the following in attendance: Chairman Eckola, Mr. Ken Jaeger, Mayor Claude Lois, Alderman Robert Miller, Ms. Lynn Greunke, City Admininistrator David Torgler, Attorney Scott Fleming. Audience members included: Alderman Frank Cannella, Mike Wiemer, John Wiemer, Roger Murray, David Stavropolus, Carolyn DeGrave, James Smith, Joanne Toman, George Toman, Attorney Robert Riegelman, Donald Lois, Linda Dornacher, Larry Dornacher, Patrick Scherrer, Ruth Wiemer, Robert Prailes, Joan Zwiebel and Attorney Tim Knurr. Jim Spiegelhoff was excused and Bil Scherrer arrived at 5:50 p.m. Arriving later in the evening was Carl Weis and Kevin McKillip.

The public hearing "Regarding the Blight Determination of the Property Located at 320 West Chestnut Street, Burlington, Wisconsin" (Bel-Mur Property) began at 5:40 p.m. with a statement by Attorney Alan Marcuvitz that all legal requirements for the public meeting had been met. The first witness called was the City of Burlington’s Building Inspector Patrick Scherrer. He discussed the general condition of the Bel-Mur building, asbestos, underground tanks, firewalls that were not properly installed and the walk-through that he had done with the City of Burlington Fire Inspector Mike Boehmer.

The second witness was Attorney Scott Fleming who stated that the legal requirements had been met for posting the Bel-Mur Building with razing notices. He also discussed the three days of testimony before Judge Vuvunas.

Mr. Larry Dornacher, 313 West Chestnut Street stated that he had lived in the area for over 31 years and had observed the general deterioration of the Bel-Mur property. He stated that he considered it to be blighted, a disgrace to the neighborhood and a fire hazard.

Mr. Dave Stavropolus the principal investor and main tenant of 320 West Chestnut stated that he had invested as much as a quarter of a million dollars into this property. He also stated he had been denied electrical and demolition permits by the City of Burlington and at that point the city started the raze process.

Attorney Marcuvitz explained the significance of the resolutions before the Community Development Authority and the process that could follow.

Eric Trier of 302 West Chestnut Street was concerned about his shed that is located near 320 West Chestnut Street and that if the buildings are razed what would happen to his shed.

At 6:55 p.m. Mayor Lois made a motion to close the public hearing, Alderman Miller seconded the motion and with all in favor the motion carried.

Mayor Lois made a motion to approve the minutes of November 15, 2001. Mr. Jaeger seconded the motion and with all in favor the motion carried.

Ms. Gruenke made a motion to approve Resolution Number 53 that was a Resolution Determining the Property Located at 320 West Chestnut Street, Burlington, Wisconsin to be blighted. Mr. Jaeger seconded the motion and on a roll call vote with Mayor Lois and Alderman Miller abstaining the motion carried.

Ms. Gruenke made a motion to approve Resolution Number 54 that was a Resolution Declaring a Public Necessity and Approving a Relocation Order for 320 West Chestnut Street, Burlington, Wisconsin. Mr. Jaeger seconded the motion and on a roll call vote with Mayor Lois and Alderman Miller abstaining the motion carried.

On a motion by Mayor Lois and a second by Ms. Greunke the CDA moved to agree to the Review and Acceptance of Wisconsin Department of Commerce Brownfield Grant Contract "subject to review by attorney". On a roll call vote all were in favor and the motion carried.

The Closed Session was not held.

At 6:59 p.m. Mayor Lois made a motion to adjourn the meeting. Ms. Greunke seconded the motion and all were in favor. The motion carried and the meeting was adjourned.
